Lt. Col. Kevin DiFalco, an active-duty officer stationed at Nellis Air Force Base in Nevada, is going to be tried by a general court-martial. He is facing several serious charges connected to sexual abuse of children.
When the Las Vegas Metropolitan Police Department caught DiFalco in 2022, he was charged with being sexy in front of a child and abuse or neglect. After the Air Force completed the proper legal steps, the charges were dropped without prejudice in June 2024. But in December 2024, new charges were chosen.
A spokesperson from Nellis Air Force Base told Military Times, "On March 27, 2025, the Office of Special Trial Counsel referred the case for trial by general court-martial." The base wouldn't say anything else about the case out of respect for the trial's dignity.
DiFalco is now being charged with seven crimes: sexual assault, sexual abuse of a child, indecent exposure, indecent behavior, giving false testimony, acting in a way that is not appropriate for an officer and gentleman, and having child pornography on his person.
When he was caught in 2022, DiFalco was in charge of Nellis Air Force Base's airfield and flight operations as the leader of the 57th Operations Support Squadron. Police records show that the accused victim, a minor, told school counselors that DiFalco had raped and sexually assaulted her from December 2021 to June 2022. She also provided proof, such as a tattoo on DiFalco's body that could be used to identify him, which police later verified.
At first, police moved quickly to solve the case. DiFalco was arrested the same day the report was made. After nearly three years, the Air Force is now preparing to utilize its military court system to bring DiFalco to justice.
The court-martial is set to start for him on September 15, 2025.
